This Privacy Policy explains what information The Client Speaks ("we," "us") collects, how we use it, and the choices you have. It applies to tenant account holders (businesses using The Client Speaks to collect feedback and testimonials) and to the customers/clients ("submitters") who submit feedback or testimonials through a tenant's hosted page. See also our Terms of Service.
We use collected information to operate the service (e.g. routing a submitted testimonial to the right tenant, generating an AI-polished suggestion when requested, sending a notification that something needs review), to prevent abuse, to process payments, and to comply with legal obligations. We do not sell your personal information.
We do not sell your personal data to third parties.
By opting into SMS notifications, you consent to receive text messages from The Client Speaks related to your account (e.g. "a new testimonial is waiting for your review"). Message frequency varies based on your account activity — these are triggered, account-related notifications, not a recurring marketing series. Message and data rates may apply. Reply HELP for help, or STOP at any time to opt out. We send a one-time confirmation text requiring a YES reply before any further messages are sent.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, except as required to provide the underlying SMS service itself (Twilio, strictly to deliver your messages) or as required by law.
You can update your notification preferences, including removing your phone number and opting out of SMS entirely, at any time from your account settings page. Opting out of SMS does not affect email notifications.
We share information only with the service providers listed in Section 4, and only to the extent necessary to provide the service. We do not sell personal information, and we do not share SMS opt-in data with any third party for their own marketing purposes.
Read this carefully: We take reasonable measures to protect your information. Data transmitted between your device and The Client Speaks is encrypted in transit using industry-standard SSL/TLS. However, no method of transmission or storage is completely secure, and we cannot and do not guarantee the absolute security of your information. You provide your information at your own risk.
No Liability for Data Breach: To the fullest extent permitted by law, you acknowledge and agree that Discovery Coaching, LLC, David Killion, and their respective officers, employees, contractors, agents, and affiliates (the "Released Parties") will not be liable for any unauthorized access to, acquisition of, disclosure of, alteration of, loss of, or use of your information resulting from any security incident, data breach, hacking, intrusion, system failure, or act of any third party, whether or not such event was foreseeable, and even if a Released Party was advised of the possibility of such an event. You release and hold harmless the Released Parties from any and all claims, damages, losses, liabilities, and expenses arising out of or related to any such event, except to the extent such liability cannot be limited or excluded under applicable law.
This section is in addition to, and does not limit, the disclaimers, limitation of liability, and indemnification provisions in our Terms of Service, which also apply to all information you provide.
We retain account and submission data for as long as your account is active, or as needed to provide the service. You may request deletion of your account and associated data by contacting us at support@theclientspeaks.com.
You may request access to, correction of, or deletion of your personal data by contacting us at support@theclientspeaks.com. We will respond within 30 days.
We do not currently respond to Do Not Track signals.
The Client Speaks is not directed to individuals under 18, and we do not knowingly collect personal information from children. If we learn we have collected data from a child, we will delete it.
We may update this Privacy Policy from time to time. If we make material changes, we will notify you via email or an in-app notice before the changes take effect. Continued use of The Client Speaks after changes take effect constitutes acceptance of the updated policy.
