1.What The Client Speaks Is

The Client Speaks is a hosted platform that helps businesses collect customer feedback and testimonials, and, if they choose, publish selected testimonials to a public testimonial wall. Businesses ("tenants," "you," "your account") use The Client Speaks to receive submissions from their own customers via a hosted page; those customers ("submitters") use that hosted page to write and optionally publish a testimonial.

By creating an account or submitting a testimonial through a hosted page, you agree to these Terms of Service.

2.AI-Assisted Testimonial Polishing

When a submitter writes a testimonial, The Client Speaks can optionally generate a polished, AI-rewritten suggestion of that text using Anthropic's Claude API. Using the AI suggestion is always optional — the submitter chooses whether to publish their original wording or the AI-suggested version, and nothing is published without their explicit consent.

AI-generated suggestions may be inaccurate, may change the meaning or tone of what was originally written, or may simply be a version the submitter doesn't prefer. The Client Speaks does not guarantee the accuracy or quality of AI-generated content, and submitters and tenants are each responsible for reviewing and approving what actually gets published.

3.Your Account and Use

Eligibility: You must be at least 18 years old to create a tenant account on The Client Speaks. By creating an account, you represent that you meet this requirement.

Account Security: You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you believe your account has been compromised.

4.Payment and Billing

Subscription Plans: The Client Speaks offers paid subscription plans. Current pricing is displayed at signup and may change with notice.

Billing: Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payment is processed via Stripe. By subscribing, you authorize us to charge your payment method on file for each billing period.

Cancellation and Refunds: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will not be charged again, but you will retain access until the period ends. We do not offer refunds for partial billing periods, except as required by law or at our sole discretion. If you believe you were charged in error, contact us at support@theclientspeaks.com.

5.Your Content and Data

You Own Your Data: Tenant account content (your business profile, settings, and submissions you receive) belongs to you. Testimonial submitters retain rights to the words they write; by submitting a testimonial and checking the consent box, a submitter grants the tenant and The Client Speaks a license to display, publish, and use that testimonial (and any photo attached to it) as described at the point of submission.

We use content to provide the service (e.g. routing a submission to the right tenant, generating an AI-polished suggestion when requested), to improve The Client Speaks, and to comply with legal obligations. We do not sell your personal data to third parties. See our Privacy Policy for full details.

6.Our Content and Intellectual Property

The Client Speaks — including the platform, design, branding, and all non-user-generated content — is owned by Discovery Coaching, LLC and protected by copyright, trademark, and other intellectual property laws. You may use The Client Speaks for your business's own testimonial collection only. You may not copy, modify, distribute, or create derivative works from The Client Speaks' own content or branding without our written permission.

7.Disclaimers and Limitation of Liability

Read this carefully: The Client Speaks is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be error-free, uninterrupted, or secure, that AI-generated testimonial suggestions will be accurate, or that use of The Client Speaks will produce specific business results.

Limitation of Liability: To the fullest extent permitted by law, Discovery Coaching, LLC, its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of The Client Speaks, even if we have been advised of the possibility of such damages. In no event will our total liability to you exceed the amount you paid us in the twelve months prior to the event giving rise to liability, or $100, whichever is greater.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for certain types of damages, so some of the above may not apply to you.

8.Indemnification

You agree to indemnify, defend, and hold harmless Discovery Coaching, LLC and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of The Client Speaks, your violation of these Terms, your violation of any third-party rights, or any testimonial content you publish or solicit through the platform.

9.Privacy

We collect account information, usage data, and content you create in order to operate and improve The Client Speaks. If you sign in with Google or Microsoft, we receive basic profile information (such as your email and name) to create and authenticate your account; their respective privacy policies apply. We take reasonable measures to protect your information, but no method of transmission or storage is completely secure. 10.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice at least 30 days before the changes take effect. Continued use of The Client Speaks after changes take effect constitutes acceptance of the updated Terms.

11.Termination

By You: You may cancel your account at any time from your account settings.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide notice when reasonably possible. Upon termination, your access to The Client Speaks will end. We may retain certain data as required by law or for legitimate business purposes.

12.Miscellaneous

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts of Contra Costa County, California.

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Discovery Coaching, LLC regarding The Client Speaks.

No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms. We may assign them without restriction.
